Last updated: [DATE]These Terms & Conditions ("Terms") govern your access to and use of the website pinkumbrella.net (the "Website") and the services offered by Pink Umbrella Healthcare Private Limited ("Pink Umbrella," "we," "us," or "our"), including membership plans, PU Mate visits, the PU App, medical coordination, and emergency support services (collectively, the "Services").
By accessing the Website, submitting an enquiry, or enrolling in any Pink Umbrella membership, you ("you," "Member," or "Subscriber") agree to be bound by these Terms. If you are enrolling on behalf of a parent, relative, or another elder ("Elder Beneficiary"), you confirm that you have the authority to do so and that you accept these Terms on their behalf as well as your own.
If you do not agree with these Terms, please do not use the Website or Services.
Pink Umbrella is an elder care subscription service based in Kolkata, West Bengal, India, offering trained companion ("PU Mate") visits, medical coordination, emergency support, vitals monitoring, and related services to elders living independently, delivered through tiered membership plans (Essentials Basic, Benefits Plus, and Advanced Benefits Premium, each available in Single and Couple variants).
To use our Services, you must be at least 18 years old and capable of entering into a legally binding agreement under Indian law. Membership may be purchased for yourself or for an Elder Beneficiary, in which case both the purchasing Member and the Elder Beneficiary are expected to comply with these Terms as applicable to their role.
Pink Umbrella offers membership plans (currently Essentials Basic, Benefits Plus, and Advanced Benefits Premium, each in Single and Couple variants) as described on the Website. Plan inclusions, pricing, billing frequency (quarterly/annually), and complimentary allowances are as stated on the Website at the time of enrolment and are subject to change with notice as set out in Section 11.
Prices displayed are exclusive of applicable GST unless stated otherwise. The final invoiced amount will include applicable taxes.
Certain benefits (e.g., complimentary credit hours, pathology discounts, ambulance coverage, tele-consultations) are subject to the usage limits, frequency caps, and conditions described in the applicable plan brochure. Usage beyond these limits will be billed separately at then-prevailing rates, which we will communicate to you before charging.
Enrolment is confirmed only after (a) submission of the enquiry/registration form or completion of the plan-selection process, (b) verification of details by our care team, and (c) receipt of payment (where applicable).
PU Mates are trained companions engaged by or affiliated with Pink Umbrella who conduct visits, accompany Elder Beneficiaries to appointments, assist with errands, and provide companionship, as per the visit frequency specified in the applicable plan. PU Mates are not medical professionals unless independently qualified and identified as such, and their role does not extend to diagnosis, treatment, prescription, or any act that constitutes the practice of medicine or nursing under Indian law.
Where a plan includes medical coordination, tele-consultations, or pathology benefits, Pink Umbrella facilitates access to and coordination with independent third-party doctors, diagnostic labs, hospitals, and ambulance providers. Pink Umbrella does not itself provide medical diagnosis, treatment, or clinical advice, and is not a hospital, clinic, ambulance operator, or registered medical practitioner.
Our 24×7 emergency line and emergency coordination service are designed to connect the Elder Beneficiary or their family with appropriate help (PU Mates, ambulances, hospitals, or family contacts) as quickly as reasonably possible. Pink Umbrella's emergency support is a coordination and response-facilitation service, not a substitute for calling local emergency services (e.g., 112/102/108) in a life-threatening situation. We strongly recommend that Members and Elder Beneficiaries also have direct access to local emergency numbers at all times.
The PU App allows Members and PU Mates to view visit updates, logged vitals, and SOS alerts, and to coordinate care. Vitals and health information displayed in the App are for informational and coordination purposes only and do not constitute medical advice. App availability is subject to Section 9 (Technology & App).
Pink Umbrella may engage independent third-party doctors, diagnostic providers, hospitals, ambulance services, and other partners to deliver parts of the Services. We take reasonable care in selecting such partners, but we do not control, and are not responsible for, the clinical decisions, treatment outcomes, or independent acts/omissions of these third parties.
You agree to:
Membership fees are billed quarterly or annually as selected at enrolment, in advance.
Unless cancelled in accordance with Section 7, memberships renew automatically at the end of each billing cycle at the then-current applicable rate, of which we will give you reasonable advance notice if rates have changed.
Failure to pay renewal fees on time may result in suspension of Services, including emergency support and PU Mate visits, after notice and a reasonable grace period.
You may request cancellation of your membership at any time by writing to info@pinkumbrella.net or through the contact channels on the Website. Cancellation will take effect at the end of the then-current billing cycle unless otherwise agreed.
Refunds, where applicable, will be calculated on a pro-rata basis for unused complete months remaining in the current billing cycle, less any benefits already availed (e.g., visits completed, pathology discounts used, ambulance dispatches, complimentary hours consumed), processed within [X] business days to the original payment method.
No refund will be made for the portion of the membership period already elapsed or for benefits already utilised. One-time enrolment or assessment-related charges (if any) are non-refundable except where required by law.
Pink Umbrella reserves the right to decline or discontinue service to any Member or Elder Beneficiary, with notice and a reasonable opportunity to address the concern, in cases of non-payment, abusive conduct toward staff, provision of false information materially relevant to safe service delivery, or safety risk to a PU Mate.

Pink Umbrella provides companion, coordination, and emergency-facilitation services with reasonable skill and care, but does not guarantee any particular health outcome, prevention of injury or death, response time, or availability of third-party medical/ambulance resources, which may be affected by factors outside our control (traffic, third-party provider capacity, network/connectivity issues, force majeure, etc.).
To the maximum extent permitted by law, Pink Umbrella's aggregate liability for any claim arising out of or relating to the Services shall not exceed the membership fees paid by the Member in the twelve (12) months preceding the claim, except in cases of proven gross negligence or wilful misconduct on our part.
Pink Umbrella is not liable for the independent acts, omissions, advice, or treatment of third-party doctors, hospitals, diagnostic labs, or ambulance operators engaged through our coordination services; your relationship with such providers is independent of Pink Umbrella, and their own terms and professional obligations apply.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable Indian law.
A lawyer should size this cap and review it against the Consumer Protection Act, 2019 before publishing — caps that are too aggressive can be struck down or invite regulatory attention for a service in this category.
The PU App and Website are provided "as available." We aim for high uptime but do not guarantee uninterrupted or error-free operation, and routine maintenance, technical failures, or third-party outages may temporarily affect access.
You are responsible for maintaining the confidentiality of any login credentials associated with your App account and for all activity under your account.
SOS/alert features within the App are supplementary to, and not a replacement for, direct emergency calls in a life-threatening situation.
All content on the Website and App — including the Pink Umbrella name, logo, "PU Mate" branding, text, graphics, and software — is owned by or licensed to Pink Umbrella and protected under applicable intellectual property laws. You may not copy, reproduce, or use this content for commercial purposes without our prior written consent.
We may update these Terms, our plans, pricing, or benefit structures from time to time. Material changes will be communicated via email, WhatsApp, or a notice on the Website at least [X] days before they take effect. Continued use of the Services after such changes take effect constitutes acceptance of the revised Terms.
If you are applying to become, or are engaged as, a PU Mate, separate terms governing your engagement, conduct, background verification, and compensation will apply and will be provided to you at the time of onboarding. Nothing on this Website constitutes an offer of employment.
These Terms are governed by the laws of India. Subject to applicable consumer protection law allowing you to approach your local consumer forum, any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.
